General Terms and Conditions of the Learn Battle App
Last updated: 11 September 2026
These Terms govern your use of the Learn Battle app as a learner. Separate Studio Terms apply to the creation and administration of learning offerings by teachers in Learn Battle Studio.
The Provider and contracting party is Lioverse UG (haftungsbeschränkt), Karl-Arnold-Straße 31, 52525 Heinsberg, Germany, represented by Annika Latz and Dennis Koob. Contact: info@lioverse.de, phone: 015789660196.
These Terms apply to the app on the respective supported devices and to the associated learning features. Individual agreements take precedence over these Terms. For orders placed through an app store, the order process states who is the contracting party for the respective order. Separate contracts with the store are governed by its terms; your claims against us are not thereby restricted.
Registration is possible from age 13. Anyone not yet 18 years old requires the consent of their legal representative, insofar as this is required by law for the contract. For data processing based on consent, we additionally observe the age requirements under data protection law; for persons under 16, consent or authorization by the legal representative is required for consent under Art. 8 GDPR.
Before completing registration, we make these Terms available for retrieval and storage. By submitting the registration while agreeing to the Terms, you submit an offer to conclude the usage agreement. The contract is concluded upon our confirmation of the registration. Mere use without corresponding inclusion does not substitute for agreement to these Terms.
Required information must be accurate and current; a permissible pseudonym may be used as a username. Login credentials must be treated as confidential. Please inform us if you have a concrete suspicion of unauthorized account access. You are liable for use of your account by others only under the statutory requirements.
Learn Battle supports learning through questions, learning packages and various practice and game modes. Depending on the available feature, you can learn alone, take part in Battles or Expeditions, create your own learning content, and use content shared by other people that has been released. The specific scope of features follows from the service description applicable at the time the contract is concluded and any additionally booked supplementary service.
The app supports the learning process. No specific learning outcome or examination result is promised. Content may originate from other users or teachers and may contain errors. The statutory requirements applicable to our contractually owed services remain unaffected. If in doubt, factual information should be verified against suitable learning sources.
The operating system versions and technical requirements necessary for use are stated before download or booking. We provide the legally required updates, including security updates, and inform you of their availability. Please install required updates once you have been informed of them.
The basic features are free of charge. A paid supplementary service requires a separate order. Before it is concluded, in particular the scope of services, the total price including applicable taxes, the billing period, the term and the termination conditions are displayed. No payment obligation arises from these Terms or from mere registration.
For an order placed directly with us, the paid contract is concluded upon our confirmation or upon activation expressly announced as acceptance. The order process must expressly disclose the payment obligation. Contract information and the applicable terms are provided on a durable medium. The language of the contract is German; entries can be corrected before submission.
Where a subscription is offered, you can terminate it at any time, effective at the end of the current agreed billing period. After an agreed initial term, a consumer subscription renews only for an indefinite period and can then be terminated at any time with a notice period of at most one month. A more favorable agreed termination option remains unaffected. An automatic conversion of free use into a paid offer takes place only on the basis of a separate, express order.
You retain your rights to your own questions, learning packages and other uploaded content. You grant us a simple, royalty-free right to store, technically process and reproduce this content and to make it accessible within Learn Battle in accordance with the release you have chosen. This grant of rights applies spatially to the extent of service operation and temporally only for as long as it is necessary for the agreed provision and its lawful handling.
We may deploy technically integrated service providers only to the extent necessary for this purpose. The grant of rights does not include general use of your content in advertising or training of AI models. Further uses require separate authorization.
Only upload content that you are permitted to use and share in the chosen form. Observe copyrights, personal rights and confidentiality. Textbooks, examination materials or third-party materials may not be shared merely because you have access to them. Do not publish personal data of third parties without the necessary authorization and legal basis.
You may use released third-party content for your own learning purposes within the scope of the features offered. Further publication, marketing or distribution of access-restricted course documents is only permitted if the rights holders allow it or the law permits it. No copyrights are transferred through the download.
If you withdraw a release or delete content, we end its further provision to the extent affected. Statutory retention obligations, legitimate preservation of evidence, and mandatory rights to uses that have already lawfully arisen remain unaffected. The privacy policy additionally applies to personal data. Statutory claims to the return of your own content after the end of the contract, in particular under Section 327p of the German Civil Code (BGB), remain unaffected.
The app indicates when a module is managed by a teacher or an admin. Responsible teachers and, for institutionally assigned modules, the institution admin, may receive aggregated usage and learning metrics. The institution admin does not receive named individual views or user identifiers of learners. For small groups, aggregated values may nonetheless allow inferences; scope, protective measures and legal bases are explained in the privacy policy.
Individual learning analytics for a teacher are provided only on the basis of a separate, active and revocable release. Participation in a managed module and acceptance of these Terms do not constitute such consent. Statutory data protection rights remain independent of these usage terms.
The joint privacy policy for the app, Studio and institutions is available at https://learn-battle.de/datenschutz-app/. Mistral is used exclusively within the "AI Assistant" and "AI Course Creation" features in Studio. App responses, learning progress and usage analytics are not automatically transmitted to Mistral. Stripe is used exclusively for teachers' self-paid Studio subscriptions.
Unlawful content, threats, harassment, discriminatory attacks, infringement of third-party rights, malware, unauthorized account access, and interference impairing the security or functionality of the service are not permitted. Automated manipulation of game results and unauthorized mass advertising are likewise prohibited.
You can report rights infringements via available reporting functions or to info@lioverse.de. Please identify the affected content as precisely as possible, for example by module, learning package, question or link, explain the reason, and provide a means of contact insofar as this is legally required. We carefully and impartially review sufficiently specific reports and inform you of our decision to the extent legally required.
In the event of concrete violations, we may, depending on severity, duration, repetition and effects, issue a warning, restrict or remove content, and temporarily suspend individual features or an account. In doing so, we take into account the interests and fundamental rights of those affected as well as the particular situation of minors. A permanent suspension or extraordinary termination requires good cause. Where appropriate, you will first be given the opportunity to comment and remedy the situation; in the case of urgent security risks or a statutory obligation, immediate action may be required.
We communicate the essential reasons, scope and duration of the measure, to the extent legally permissible. You can request a review by a responsible person at info@lioverse.de. Statutory complaint, dispute resolution and legal remedies remain unaffected. A blanket indemnification against all third-party claims is not agreed.
We provide the agreed services with reasonable care. Necessary maintenance, security measures and unavoidable disruptions may cause interruptions. We announce plannable, significant restrictions in good time where possible and keep them as short as reasonable. Unrestricted availability at all times is owed only where expressly agreed.
Statutory warranty rights apply. For consumer contracts regarding digital products, Sections 327 et seq. of the German Civil Code (BGB) apply in particular, insofar as their requirements are met; this may also be the case for free use where personal data is provided. Designation as a beta version does not remove statutory rights. Deviations from objective requirements require the statutorily prescribed separate information and agreement.
We are liable without limitation for intent and gross negligence, for culpable injury to life, body or health, and to the extent of any guarantee assumed. Mandatory liability, in particular under the Product Liability Act and Art. 82 GDPR, remains unaffected.
In the event of slightly negligent breach of material contractual obligations, liability is limited to the foreseeable damage typical for the type of contract at the time of conclusion. Material contractual obligations are those whose fulfillment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely. Otherwise, liability for slightly negligent damage is excluded. These provisions also apply to our statutory representatives and vicarious agents. Statutory warranty rights remain unaffected.
You can terminate the free usage agreement at any time, in particular by deleting your account or by email to info@lioverse.de. We can terminate it with four weeks' notice. Both parties' right to terminate for good cause remains unaffected. A termination initiated by us must not circumvent existing claims arising from paid services.
For paid supplementary services, the terms agreed at the time of order and Section 4 apply. Terminations to us are possible at least in text form, for example by email. Insofar as Section 312k BGB applies, a directly and easily accessible termination button is additionally available. For subscriptions concluded via an app store, please note the contracting party named there and the store's account management; mandatory termination rights remain unaffected.
Termination of a supplementary subscription does not automatically delete your user account. Uninstalling the app does not end a contract. Before an announced termination, you receive a reasonable opportunity to back up your own content to the extent legally owed. Data deletion and any necessary limited retention are governed by the privacy policy and the law.
We provide required updates to maintain conformity with the contract in accordance with statutory requirements. We may make further changes to a continuously provided digital service if there is a valid reason, such as adapting to new technical environments or security requirements. They must not cause additional costs; we inform you clearly and comprehensibly about the change. A valid reason does not permit arbitrary withdrawal of material agreed features.
If such a change impairs access or usability more than insignificantly, we inform consumers in advance and in good time, on a durable medium, of the characteristics, timing and the statutory right to terminate the contract free of charge within 30 days. The commencement and exceptions are governed by Section 327r BGB, in particular where an unchanged, contractually compliant version remains usable without additional cost.
Changes to these Terms or agreed prices become part of the contract only on the basis of an effective agreement or a statutory authorization. Silence, continued use, or a mere change to the published version do not constitute consent. Claims already acquired remain unaffected.
Consumers have a right of withdrawal where the statutory requirements are met. This may also apply to a free-of-charge digital service where personal data is provided. The following notice concerns contracts with Lioverse for the ongoing app service. For separately ordered individual digital content, the information required for this is provided before the order.
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract was concluded.
To exercise your right of withdrawal, you must inform us, Lioverse UG (haftungsbeschränkt), Karl-Arnold-Straße 31, 52525 Heinsberg, Germany, email: info@lioverse.de, phone: 015789660196, by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the model withdrawal form below, although this is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
If you withdraw from this contract, we will reimburse all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), without undue delay and, in any event, no later than fourteen days from the day on which we received notice of your withdrawal from this contract. For this repayment, we will use the same means of payment you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged fees as a result of this repayment.
If you requested that the services should begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of services already provided up to the point at which you notify us of your exercise of the right of withdrawal from this contract, compared to the total scope of services provided for in the contract.
Compensation for value regarding services is due only under the statutory requirements, in particular where you were duly informed and expressly requested early commencement of performance. No compensation for value is due for free-of-charge use. Merely logging in or agreeing to these Terms is not a statement regarding early expiry of your right of withdrawal. For an ongoing digital service, a statutory right of withdrawal does not expire solely because the account is activated.
For distance contracts concluded via our online interface, you can additionally use the easily accessible "Cancel contract" function available there during the withdrawal period and submit your statement via "Confirm withdrawal". You will promptly receive an acknowledgment of receipt on a durable medium. Other permissible means of withdrawal remain available.
If you wish to withdraw from the contract, you may complete and return this form.
